
Employers in the Fund
The Local Government Pension Scheme is a public service pension scheme which is managed nationally and administered locally by administering authorities such as The Tyne and Wear Pension Fund.
Employers who participate in the Local Government Pension Scheme fall into one of the following categories:
Schedule 2 Part 2 Employers - Some LGPS employers have the power to decide if an employee or group of employees can belong to the LGPS and pass a resolution accordingly.
Schedule 2 Part 1 Employers - A Scheme Employer is a body defined as such within the 1997 Regulations. Such Employers must participate in the Pension Scheme.
Admission Bodies - To simplify the structure of the 1997 regulations those regulations that enable local government employers to make admission agreements with certain non-scheme employers have been restated and expanded. The requirements for admitted bodies have been divided into two separate regulations, one detailing Community Admission Bodies and the other, Transferee Admission Bodies.
Community Admission Bodies - An administering authority may make an admission agreement with any community admission body. Community admission bodies are bodies that provide public services other than for gain, and which have links with local government.
Transferee Admission Bodies - An administering authorities may make admission agreements with any transferee admission body. A transferee admission body is:-
a body which is providing, or will provide, services or assets in connection with the exercise of a function of a Scheme employer as a result of:-
i) the transfer of the service or assets by means of a contract or other arrangement between that Scheme employer and the body;
ii) a direction made under section 15 of the Local Government Act 1999; or
iii) directions made under section 497A of the Education Act 1996;
The Regulations extends the definition of transferee admission body to include bodies (other than community admission bodies) that carry out a public service and have been approved by the Secretary of State for admission to the Scheme.
